Photographer's Terms of Service
1. Overview
This agreement is entered into between the photographer Risa Scott Photo/RF Scott Imagery, hereinafter referred to as the "Photographer," and the client, hereinafter referred to as the "Client." These terms of service govern the provision of photography services as described in the accompanying agreement and/or invoice.
2. Services
The Photographer agrees to provide the Client with professional photography services as outlined in the agreed-upon package. This may include but is not limited to: event coverage, headshot/portrait sessions, product/lifestyle photography, commercial photography, travel imagery, and post-production editing.
3. Payment and Pricing
The Client agrees to pay the Photographer the agreed-upon amount as outlined in the invoice or contract. A non-refundable deposit may be required to secure the Photographer's services, with the remaining balance due on or before the date of the event or session. Additional fees may apply for travel, accommodation, or other agreed-upon expenses.
4. Cancellation and Rescheduling
In the event of cancellation or rescheduling, the Client agrees to provide the Photographer with reasonable notice. The non-refundable deposit may be forfeited in the case of cancellation. The Photographer reserves the right to reschedule in case of unforeseen circumstances such as inclement weather, illness, or other emergencies.
5. Image Ownership and Usage
The Photographer retains the copyright to all images taken during the session or event. The Client is granted a non-exclusive, non-transferable license to use the images for personal use. Commercial use of images requires written permission and may incur additional fees. The Client agrees not to edit or alter the images without the Photographer's consent.
6. Model Release
The Client grants the Photographer the irrevocable and unrestricted right to use and publish photographs of the Client and/or event for promotional purposes, including but not limited to online portfolios, social media, and marketing materials.
7. Delivery of Images
The Photographer will provide the Client with a gallery of edited, high-resolution images within a reasonable timeframe as specified in the agreement. The method of delivery will be discussed and agreed upon between the Photographer and the Client.
8. Client Cooperation
The Client agrees to cooperate with the Photographer to achieve the best possible results, including but not limited to providing a shot list, coordinating with other vendors, and following the Photographer's direction during the session.
9. Liability
The Photographer is not responsible for any injuries or damages that may occur during the session or event. The Client is responsible for the safety and behavior of all individuals involved in the shoot.
10. Governing Law
This agreement shall be governed by and construed in accordance with the laws of the state in which the shoot takes place. Any disputes arising under or in connection with this agreement shall be resolved through arbitration in accordance with the rules of the American Arbitration Association.
By entering into this agreement and accepting the work order, the Client acknowledges that they have read, understood, and agreed to all terms and conditions outlined herein.
